VirnetX +28.1% on Apple patent victory

VirnetX is a patent-assertion entity, meaning its entire business model rests exclusively on suing companies that actually develop and sell products based on arcane patent infringement laws and loose interpretations of intellectual property regulations. It's small change for Apple, but an important win for VirnetX.

This could be a short-lived victory for VirnetX, however. According to Bloomberg, a federal court in Texas wrapped up the most recent case earlier today, ruling that Apple infringed on VirnetX patents with iMessenger and FaceTime.

In a statement to Bloomberg, VirnetX CEO Kendall Larsen called the damages amount "fair".

The intellectual property battle - relating to FaceTime, iMessage and VPN on Demand - started back in 2010, with VirnetX claiming that Apple was violating four of its patents pertaining to communication security. VirnetX is based in Zephyr Cove, Nevada, and it filed its suit in patent troll-friendly East Texas, a district where patent holders have had a higher chance of success in intellectual property cases until the Supreme Court cracked down on the practice previous year. "Tell the truth and you don't have to worry about anything".

While VirnetX won, the Patent Trial and Appeal Board (PTAB) may end up having the final say in this outcome. Apple has been targeted by this twice over the last several years. Since that time, there have been numerous trials and appeals. A jury had already awarded VirnetX $302 million, which was later increased to $439.7 million and has now gone up to $502.6 million.
