Mr Evans said a jet was waiting at John Lennon airport and it is understood he plans to take his son to the Vatican-linked Bambino Gesu Paediatric Hospital in Rome for diagnosis and possible treatment after they received backing from Pope Francis.

A lawyer representing Tom Evans, 21, and Kate James, 20, asked judges at the Court of Appeal today to rule that Alfie Evans be allowed to leave Britain to receive treatment.

A United Kingdom judge denied an appeal from Alfie Evans' parents Monday to have him treated outside the country, saying their parental rights did not matter.

The parents lost their bid to allow Alfie to be taken overseas for treatment.

Alfie's parents fought the decision to the Supreme Court and before the European Court of Human Rights.

"As has been determined with considerable clarity in this case, Alfie's best interests are determinative and the court has decided what treatment he should or should not receive".

"Alfie, the family and all of our supporters are stronger than ever".

Judges have heard how Alfie, born in May 2016, is in a "semi-vegetative state" and has a degenerative neurological condition that doctors have been unable to diagnose definitively.

Specialists at Alder Hey said life-support treatment should stop and Mr Justice Hayden said he accepted medical evidence which showed that further treatment was futile. Tom also claimed he had video evidence of hospital staff falling asleep during times in which they were supposed to be caring for Alfie.

Barrister for the parents, Paul Diamond, said the couple might make a further appeal to the Supreme Court.

"In our view the arguments advanced on behalf of the parents provide no basis on which Alfie could be said to be detained, or on which he could to be said to be unlawfully detained", Moylan said, according to Liverpool Echo.

A date was set last week at London's High Court to terminate Alfie's life support but it was not made public for legal reasons.

Speaking outside the hospital, Alfie's dad declared "it's not over" while crowds of supporters chanted "get him out". The protests have allegedly caused road blockages and prevented some staff from entering the hospital.

Chief Inspector Chris Gibson said: "Whilst many people have gathered to protest in a peaceful way, Merseyside Police is now investigating a small number of reports, some of which originate from social media, as well as instances of verbal abuse and acts of intimidation from those outside the hospital".

However, Alder Hey said in a statement: "Noise from recent protests has unfortunately affected our patients so we would ask that noise levels outside the hospital are kept to a minimum and, for example, vehicle horns are not sounded".
