How Politicians Win Without The Most Votes: Gerrymandering Explained

The judges said the state legislator responsible for the 2016 map had said he drew it to give Republican candidates an advantage. "They recognized the egregious nature of what the North Carolina General Assembly did in 2016, purportedly to remedy another unconstitutional congressional redistricting plan".

A panel of federal judges struck down North Carolina's congressional maps as unconstitutional partisan gerrymanders this evening, handing a big win to Democrats hoping to take on the Republican majority in the state's congressional delegation.

Federal judges said that North Carolina will have to redraw its 13 congressional districts because the map violates the Equal Protection Clause, the First Amendment, and Article I of the Constitution.

The judges are now giving the General Assembly two weeks to provide new maps to that fix the issue. He studies state legislatures and redistricting, among other aspects of American politics.

Republicans plan to appeal the decision.

Rick Hasen, professor of law and political science at the University of California at Irvine, said that Republicans would likely appeal the decision back to the Supreme Court. They included Wynn, who had been appointed by President Barack Obama; Earl Britt, who had been appointed by President Jimmy Carter; and William L. Osteen Jr., who had been appointed by President George W. Bush, according to the News & Observer.

Duchin noted that there are three high-profile cases where courts plan to explore methods for measuring partisan gerrymandering. Over the ensuing decade, academics worked to provide Kennedy (often the "swing" vote on the high court) with such a standard. In oral arguments, Kennedy appeared sympathetic to the plaintiff's case.

Thus, there's a good chance that North Carolina Republicans will (at least) be able to run one more election on their rigged map, while the Supreme Court sorts these other cases out.

For Mattingly, Tuesday's ruling was "an important step in the conversation" about the use of mathematics to illuminate such problems.

The quote came from state Rep. David Lewis, R-Harnett, who also announced during the 2016 redraw that the new map was built to elect 10 Republicans and three Democrats "because I do not believe it's possible to draw a map with 11 Republicans and two Democrats".

In ruling the current map drawn by Republicans is illegally gerrymandered, the judges gave lawmakers until January 24 to redraw the districts. But the North Carolina case indicates how savvy political operators can game the system while keeping districts looking fairly tight and compact.

Democratic members of Congress reacted with applause as news of the decision percolated through North Carolina's political corners Tuesday.
