Transport minister Thomas Chandy will step down 'If CM asks so'

A division bench of the court severely criticized the minister for such a move, saying that he can not approach the court as a minister and a common man at the same time.

A bench comprising justices P N Raveendran and Devan Ramachandran held that a minister can not file petition against his own government, which had ordered the district collector to look into the matter and submit a report.

"Never before has the court made an observation that the cabinet has lost its collective responsibility".

The division bench of the court of Justice P.N. Ravindran and Justice Devan Ramachandran came down heavily on Chandy and observed that it was very odd what a state Minister has filed a petition against the state government "which questions the failure of the collective responsibility of the cabinet".

He also stated that he approached the court as an ordinary citizen and not as a minister.

Significantly, appearing against Chandy on Tuesday, government counsel strongly argued in favour of the probe report and called the minister's opposition to it "immature". The court rejected Chandy's petition and asked why the government had not sacked him for opposing an official probe, regional news channel Manorama News reported. The CPI, the second largest party in the ruling coalition, persisted with a different tone - "When ministers lead parties, instead of parties leading their ministers, we have such unfortunate situations", state secretary Kanam Rajendran said.

NCP state leadership on Tuesday chose to leave the decision on the demand for Chandy's decision to the party's parliamentary board.

Earlier in the day, Chief Minister Pinarayi Vijayan said an "appropriate decision" would be taken at the right time after examining the high court order and the NCP's decision.

The LDF entrusted chief minister Pinarayi Vijayan on Sunday to take a decision.

NCP state president TP Peethambaran Master along with other party leaders will meet CM. The leaders of the party maintained high probity in public life.
