Jennifer Hudson and fiancé David Otunga split after 10 years

"As a result of Mr. Otunga's career in the WWE, Ms. Hudson felt that she could give an award winning performance in court to portray herself as the victim".

TMZ broke the story ... cops kicked David out of the family home Thursday night after Jennifer got an order of protection claiming she feared him, he had gotten physical with her and he was a threat to her and her son. Though they live in the same home, they have been sleeping in separate rooms for at least six months. Hudson says that the former pro wrestler "mistakenly believes" the singer is romantically involved with one of her producers, so Otunga told their son over the phone: "Don't let your mom's boyfriend mother f-king touch you".

'David knows that I'm and have been very sensitive to firearms after my mother and my brother were murdered by a firearm.

Hopefully David and Jennifer are able to work out their differences during their time of uncoupling that provides both a safe and healthy environment for their 8-year-old son. Otunga grabbed his son by the arm and took him upstairs to his master bedroom, she said.

Jennifer has also called the gospel singer her "dream artist".

Hudson added that Otunga recently left his firearm out on their kitchen table. She said he told her it was a prop, though she doesn't believe him.

Hudson's rep pointed out that the protective order against Otunga was requested for keeping their son's best interests in mind.

TMZ.com is now reporting that police have opened a domestic battery investigation into David Otunga. The police can not disclose the identity of the parties involved, though E!

The new report also notes that Hudson is denying the allegation.

If Otunga is charged, it would be a misdemeanor.

Only one month after they became engaged, tragedy struck for Hudson when her mother, Darnell Donerson and her brother, Jason Hudson, were shot and killed in their Chicago home while Hudson's nephew Julian King, 7, was also found dead in the vehicle.
