CT Supreme Court Hears Case Against Gun Maker In Sandy Hook Massacre

Connecticut's highest court heard arguments Tuesday over whether the families of victims of the Sandy Hook school massacre can revive their lawsuit against the company that made the rifle that Adam Lanza used to kill 20 schoolchildren and six adults in 2012.

Likewise, Koskoff told the CT court on Tuesday, Remington marketed its Bushmaster XM15-E2S directly at people like Adam Lanza - people whom the lawsuit describes as young men "obsessed with the military", specifically elite units like the Army Rangers, and "uninterested in hunting or target shooting" (italics in original).

The case centers on a Bushmaster AR-15-style rifle made by North Carolina-based Remington and a 2005 federal law that shields gun makers from liability in most cases. In court filings, the company has said the families' claims, first filed in 2014, are barred by the 2005 law.

Lawyers for the family members asked the court to revive the suit that was dismissed a year ago by Judge Barbara Bellis in Bridgeport, Connecticut.

The nation is watching the case closely because if the families succeed, and the state Supreme Court allows it to move forward, it could lead to a flood of lawsuits against gunmakers.

Adam Lanza, 20, used a Remington AR-15 Bushmaster rifle, a semi-automatic civilian version of the USA military's M-16, to kill 20 schoolchildren between the ages of 6 and 7, as well as six adult staff members.

The attorney for the 10 families, Josh Koskoff, argued the gun maker can be held responsible under a legal concept called negligent entrustment, which applies when the supplier knows, or should know, the user is likely to harm others, WCBS 880's Alex Silverman reported. Newtown was the site of the 2012 Sandy Hook school shooting. But defense attorneys contend that the exception is used for gun sellers, not manufacturers. However, the families said they will be making comments after the hearing.

"Remington may have never known Adam Lanza, but they had been courting him for years", Koskoff said.
