Apple Served Warrant To Unlock Texas Shooter's IPhone

The San Antonio Express-News reported on November 16 that the Texas Rangers have served a search warrant to Apple, seeking data on Devin Kelley's encrypted iPhone.

According to reports, Texas Rangers seek data on Kelley's iPhone SE with access to both local and iCloud information. They've also obtained a warrant for files stored on a second mobile phone (made by LG) that was found at the scene of the shooting.

The FBI eventually received assistance to break into the iPhone from an Israeli startup, which claimed to be able to perform "file system extractions, decoding and analysis" on locked iPhones "with a simple or complex passcode".

The FBI carried out investigative activities in which they sent a formal request to Apple to unlock an iPhone the attacker to learn the motives of his brutal attack.

Despite struggling to unlock the phone - something agent Christopher Combs complained about during a press conference - the agency didn't call the Cupertino firm, instead sending the device to its own crime lab.

Police have served Apple with a search warrant for data from the iPhone used by the gunman in the Sutherland Springs, Tex.

Unlike in the San Bernardino case in 2015, this time Apple offered to cooperate with authorities shortly after the press conference, but nobody has reached out to Apple regarding the matter since the warrant was issued.

Last week, Federal Bureau of Investigation special agent Christopher Combs alluded to the ongoing dispute between the DOJ and Apple during a press conference and placed at least some blame on the tech giant.

An Apple spokesperson said the company does not comment on law enforcement matters. That would have been an easy task if authorities had contacted Apple right away for assistance, but they waited too long.

Last year, such an order was issued for an iPhone owned by one of San Bernardino shooters, prompting Apple to refuse the order on the grounds it would spark days of bad publicity, er, sorry, jeopardize the security of all its handsets and set a awful precedent.

First of all, law enforcement probably had the chance to unlock Kelley's phone using the fingerprint off of Kelley's cold, dead hand. After the San Bernardino shooting, there was speculation that the deceased shooter may have had accomplices, which would make the contents of his phone critical evidence. While those efforts have not yet been successful, FBI investigators haven't given up hope they can find a solution, said individuals familiar with the matter.
