SCA rejects Zuma's spy tapes appeal

On Friday morning the Supreme Court of Appeal in Bloemfontein dismissed Zuma's and the National Prosecuting Authority's appeal in what became known as the "spy tapes" case.

Justice Leach, who only took eight minutes to hand down his ruling, said that the manner in which the case was conducted on behalf of the NPA was inexcusable.

Zuma wanted the opportunity to make fresh representations before the NPA chose to recharge him.

Shortly before the 2009 polls, after Zuma had won the contest for the leadership of the ruling African National Congress, Mpshe, withdrew 783 charges linked to the multi-million rand 1999 arms deal.

The NPA said it accepted that Mpshe could not rely on section 179 of the Constitution, as he'd earlier declared, as this section did not allow the prosecuting authority to review its own decisions.

The opposition Democratic Alliance party had sought in 12 court appearances since 2009 to reactivate the charges over controversial post-apartheid military contracts which have dogged Zuma for much of his time in government.

Since then, the DA has challenged the matter in court.

The Supreme Court of Appeal has rejected, with costs, President Jacob Zuma's appeal in his long running battle to avoid prosecution for fraud and corruption.

Advocate Kemp J Kemp, SC, for Zuma, told the full bench of justices that he believed that the NPA had erred in their decision.
