Court Hearing That Could Reinstate Ezekiel Elliott's Suspension Slated for October 2

Ignoring the league's request for a ruling by September 26 on the emergency motion to stay the injunction that allows Cowboys running back Ezekiel Elliott to play while the legal challenge to his six-game suspension proceeds, the Fifth Circuit has set oral argument on the matter for Monday, October 2. That could, however, change quickly.

The hearing will take place in New Orleans and lawyers for the NFL and NFL Players Association have been authorized 20 minutes of argument time for each side.

NFL Vice President of Communications Joe Lockhart said the situation remains at the discretion of commissioner Roger Goodell if there is a ruling over the weekend.

The 5th U.S. Circuit Court of Appeals in New Orleans posted the notice Friday, clearing the way for last year's National Football League rushing leader to play Monday night at Arizona and at home October 1 against the Los Angeles Rams. Judge Amos L. Mazzant ruled in favor of Elliott and overturned his suspension, citing "unique and egregious facts" from the case that required "court intervention".

The NFL initially suspended Elliott for the first six games of the season August 11 following an investigation into domestic violence allegations made against him by his ex-girlfriend, Tiffany Thompson.

Elliott turned in a strong performance against the Giants in Week 1, rushing for 104 yards on 24 carries, but was bottled up against the Broncos in a loss last week and managed just eight yards on nine carries.
