Jury deadlocks in Cosby trial; judge says keep deliberating

Prosecutors would have the option of seeking a retrial if the jury can not reach a verdict.

Cosby's defense moved immediately for a mistrial, but the judge denied the motion.

Jurors continued their work a day after telling the judge they were unable to reach agreement on a unanimous verdict.

"I'm feeling so frustrated".

The jurors asked for a reading of part of Cosby's deposition from more than a decade ago in which he described giving pills to Constand on the night of the alleged sexual assault in 2004.

Cosby met Constand in late 2002 when he attended a basketball game at Temple University, his alma mater, in Philadelphia.

"So it's always hard to look under the hood and see the reality of our lives", Kline said. "We can only hope the judge- if they don't have a verdict right now- will release them, and say this is a deadlock". According to an affidavit, Constand has accused Cosby of drugging her with three blue pills and then making physical contact without her consent including forcing his hands into her pants and coercing her into touching his erect penis in 2004. Constand says Cosby gave her pills that made her woozy, then violated her.

Count one is the matter of consent: did Andrea Constand say "yes" to engaging in sexual contact with Cosby?

Attorney Michael Bressler, who has been watching the trial proceedings, said long deliberations, in general, could be an indication that an ongoing debate is happening behind the closed doors as jurors take "issue with some of the facts". He says he believed a chat with the family from Plymouth Meeting would brighten Cosby's spirits. Judge Steven O'Neill gave them instructions to try again, issuing a "dynamite charge" or "Allen charge", meant to motivate an uncertain jury to reach a decision.

Pennsylvania detectives spoke to Cosby in his lawyers' New York City offices a few weeks after Constand went to police in January 2005.

The judge told them to keep trying.

Each of the three counts carries a sentence of from five to 10 years in prison if Cosby, who's 79, is convicted. Constand said on the witness stand she did not know Jackson. The district attorney's office declined to comment.

Jewel Allison, one of dozens of women who have accused Cosby of sexual assault, said the jury's note was "emotionally devastating". In that case, prosecutors would get four months to decide whether they want to retry the TV star or drop the charges.

The jury has asked questions specifically relating to Constand's original police report which contradicted her testimony Tuesday.

But the defense team for Cosby, who did not testify, sought to portray the sexual encounter as romantic. Cosby said in the interview that he gave her Benadryl, an over-the-counter cold and allergy medicine, to help her relax.
