Another mistrial of United States officer who killed black man

Brian Taylor of the Black Lives Matter movement in Cincinnati calls the mistrial in Officer Ray Tensing's case "blatant injustice" and a "textbook example" of institutionalized racism at work. Last week, a jury acquitted Minnesota officer Geronimo Yanez on charges stemming from shooting Philando Castile, who had indicated he had a legal firearm in his auto when he was stopped.

The hung jury deliberated for almost 31 hours over five days, but could not come to a unanimous decision.

The decision, which came hours after the jury informed the judge that it could not reach a unanimous decision on either count in the case, marked the end of the second trial for Tensing.

Shortly after the shooting, Hamilton County Prosecutor Joe Deters said Tensing "never should have been a police officer".

Tensing testified he shot DuBose because he feared for his life after his left arm became trapped inside DuBose's moving auto on July 19, 2015. Tensing told him to take his seat belt off as he opened DuBose's auto door, but DuBose started to pull away. "Tensing pulled his weapon and fired to avoid, he said, being dragged under DuBose's auto", WVXU reported.

She sent them back to the jury room to deliberate further.

On Friday, the DuBose family demanded yet another retrial and called on the community to join them in "peaceful protest of this unjust result".

Jurors in the second trial consisted of nine white jurors and three black jurors. As I tell people all the time, there's always a final court. The white officer had just arrived on the scene of a suspected crime and, according to a police statement, failing to recognize his black colleague and "fearing for his safety", shot him in the arm.

Their exchange lasts less than two minutes and was captured on body camera video.

By comparison, the first trial jury consisted of six white women, four white men, and two African-American women. Prosecutors, though, have argued that Tensing had not been in serious danger and that the use of deadly force was unnecessary. Tensing opens the driver's door a few inches, but DuBose pulls it back closed.

In November, a judge declared a mistrial in the initial proceeding after the jury deadlocked.

CORNISH: And this is the second time Tensing has been tried on these charges. "This is the most asinine act I have ever seen a police officer make", he said at the time. The university reached a $5.3 million settlement with DuBose's family, including free undergraduate tuition for DuBose's 13 children. When DuBose couldn't find it, Tensing grew frustrated and asked the motorist to undo his seat belt. And then when DuBose either will not or can not provide a driver's license, Tensing starts to open the vehicle door, and then everything just falls apart from there.
